Each plaintiff has a choice as to whether to file a non-class action case in Federal or State Court. The class action cases (non-severe consequences) are being handled in Federal Court. Gordon, this is not accurate. You should talk to Don Nolan and correct this entry. Most of the death cases have been filed in Federal Court. No class action has been certified or is being pursued in either state or federal court. Only serious injury or death cases are worth pursuing.
